For OpenMedias publications on its partner websites

OpenMedias, a Simplified Joint-Stock Company (Société par Actions Simplifiée) with a share capital of 60,000 euros, registered with the Paris Trade and Companies Register under number 849 100 243, with its registered office at 13 ter boulevard Berthier, 75017 Paris (hereinafter "OpenMedias"), publishes commercial publications on partner media websites providing various information about different services and products.

These Terms of Service (hereinafter the "ToS"), governed by French law, are intended to regulate the use of this information. Reading this information constitutes full, express and unreserved acceptance of the ToS by the reader.

Any contrary condition not accepted by OpenMedias shall not be enforceable against it. The fact that OpenMedias does not invoke any of these terms and conditions shall not constitute a waiver of its right to invoke them at a later date.

OpenMedias expressly states that all of its content is of a commercial nature and that all the information provided has been supplied by its advertisers; their reliability cannot under any circumstances engage the liability of OpenMedias.

Article 1. Definitions

Content: refers to all information and commercial publications accessible on the various partner websites of OpenMedias, including their general structures, texts, numerical data, graphics and tables, animated or static images, videos, sounds, hyperlinks of which the publications are composed, distinctive signs, trademarks and logos constituting their graphic charter, and associated databases.

Website: refers to the partner websites of OpenMedias hosting the commercial content of its clients.

Advertiser: refers to a company wishing to distribute an advertising message in order to promote its products and/or services.

Publication: refers to a body of text and/or video content, whether in the form of an interview or an article.

User: refers to the reader of OpenMedias' commercial publications.

Article 2. User Liability

2.1 General liability in the context of using the Website and information available on the Website

The User uses the Publication and the information provided by the Advertiser within the Publications at their own risk and under their full responsibility.

The Content, comments and any other data displayed on the Website are not intended to constitute advice upon which a purchasing decision could be made by the User. OpenMedias disclaims all liability for any reliance placed by any User of the Website on such data and information, or by any person who may be informed of this Content. The User must under no circumstances consider the Content or other information presented on the Website to be accurate or up to date, but must independently verify all such information.

Neither OpenMedias nor any of its partners shall be held liable for any direct or indirect, consequential, special, incidental or punitive damages that may result from errors or omissions.

The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, OpenMedias cannot be held liable in the event of an error in any of these photographs or texts.

The Content offered complies with current French legislation. OpenMedias cannot be held liable for non-compliance with the legislation of the country from which the connection is made.

OpenMedias warns persons holding parental authority about the diversity of available content, which may be likely to offend the sensitivities of minors or cause them harm. Parents are therefore encouraged to supervise their children when they connect.

2.2 Special warning regarding health Content. No OpenMedias publication constitutes a medical consultation

The information and services offered within our publications do not constitute, either directly or indirectly, a medical consultation. Under no circumstances may the information and services offered be considered a substitute for a consultation, visit or diagnosis made by a doctor, nor may they be interpreted as promoting medications.

The User must therefore not use the information available on the Website for making a diagnosis, determining a treatment, or starting and/or stopping any medication without first consulting a general practitioner or specialist.

The User acknowledges that the information made available does not cover all the different symptoms, medications and treatments appropriate to the conditions and various daily ailments of interest to them.

Furthermore, OpenMedias does not guarantee any results following the implementation of the information and services offered on the Website.

Consequently, the User acknowledges that OpenMedias cannot be held liable for health-related content communicated on the Website, and accepts that the use of this information and services is carried out under their sole and full responsibility, control and direction.

2.3 Special warning regarding stock market Content, investment advice and information. OpenMedias is not responsible for investment advice

The User acknowledges and unreservedly accepts being fully responsible for any action taken following the reading of any advice, opinion, view, financial quotation or any other information contained in the commercial publications published by OpenMedias on behalf of its Advertisers.

The User is fully aware of the random nature and the risk involved in investing in securities and similar or equivalent products. They retain full and complete responsibility for such investments.

The User undertakes to comply with all applicable stock market legislation, and in particular not to disseminate false information or press releases from listed companies, to comply with the rules applicable to the stock market arising in particular from the various regulations of the Financial Markets Authority (AMF) and the provisions of the Monetary and Financial Code relating to market abuse (insider trading, disclosure of privileged information, dissemination of false information, market manipulation, illegal speculation, etc.).

Article 3. Website Availability

OpenMedias cannot be held liable for any damage, of whatever nature, resulting from the unavailability of the Website.

Article 4. Links

The Website contains information provided by external companies or hyperlinks to other websites that have not been developed by OpenMedias. The existence of links from the Website to other websites does not constitute validation of those websites or their content by OpenMedias. It is the User's responsibility to use this information with discernment and critical thinking. OpenMedias cannot be held liable for information, opinions and recommendations made by third parties.

OpenMedias has no means of controlling these websites (and/or the products and services they offer) and these sources, and is not responsible for and does not guarantee the availability of such external websites and sources.

OpenMedias does not claim ownership of the content to which these websites or sources provide access, and excludes all liability and warranty regarding their content.

Links are partly created automatically and cannot all be verified by OpenMedias staff. However, if a link to an external page containing illegal content is found within the Website pages, OpenMedias will remove the link to that page after being duly informed of said content.

Article 5. Applicable Law – Jurisdiction

These ToS are governed by French law. In the event of a dispute, French courts shall have sole jurisdiction.

Article 6. Amendments to the ToS

OpenMedias reserves the right to adapt or modify these ToS at any time. The new terms and conditions will, where applicable, be brought to the attention of the User by online modification.
